1. PROMOTION: The Biolage Best Sellers Sweepstakes (the “Sweepstakes”) starts on May 2, 2023, at 12:00 AM Eastern Time (“ET”) and ends at 11:59 PM ET on May 14, 2023 (“Sweepstakes Period”). Sponsor’s computer shall be the official timekeeper for all matters related to this Sweepstakes.

 

2 ELIGIBILITY: Open only to legal residents of the fifty (50) United States (excluding Puerto Rico) and the District of Columbia, 16 years of age or older at the time of entry. Anyone under the age of majority in their state (eighteen (18) in most states, nineteen (19) in Alabama and Nebraska, and twenty-one (21) in Mississippi) at the time of entry must also have the consent of one of their parents or legal guardian, and a parent or other legal guardian must agree to the enforceability of these official rules. Void where prohibited. Employees (and their immediate families, including parent, child, spouse, or sibling, and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of Biolage (“Sponsor”) and its respective parents, affiliates, subsidiaries, and advertising and promotion agencies are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this Sweepstakes. Sweepstakes is subject to all applicable federal, state, and local laws.

 

3 TO ENTER: There are two (2) methods of entry during the Sweepstakes Period:

Online Entries: You must be a logged-in Facebook or Instagram user. On the "organic and promoted ad" click the "Sign Up" blue button to be entered for a chance to win.

Mail Entries: To enter without completing the survey, hand-print your full name, full mailing address, email address, and phone number on a plain 3x5 inch paper. Mail your completed mail entry in a properly stamped #10 envelope to: Biolage Best Sellers Sweepstakes, c/o Biolage, 10 Hudson Yards, New York, NY 10001. Mail-in entry must be postmarked no later than May 14, 2023, and received by May 22, 2023, to be eligible.

Limit one (1) entry per person for the duration of the Sweepstakes Period regardless of method of entry. Multiple entries received from any person after the first entry received will be void. Entries generated by script, macro, or other automated means or means which subvert the entry process will be void. All Entries become the property of Sponsor and will not be acknowledged or returned.

Creating an account is free, and you may be asked to agree to the terms of service and privacy policy of Facebook and Instagram. This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Facebook or Instagram. 4. DRAWING: One (1) potential winner (“Potential Winner”) will be selected in a random drawing held on or about June 26, 2023, from all eligible entries received by Sponsor. Odds of winning depend on the number of eligible entries received.

 

 

5 WINNER NOTIFICATION: Potential Winner will be notified on or about July 24, 2023, via email. Potential Winner may be required to execute and return an affidavit of eligibility, a liability release, and, where lawful, a publicity release within seven (7) days of the date of issuance. If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, Sponsor is unable to contact a Potential Winner, Potential Winner does not respond to Sponsor’s communication within 48 hours from the time of contact for any reason, or a Potential Winner is not in compliance with these Official Rules, the prize will be forfeited. At Sponsor’s discretion, up to three (3) alternate winners may be determined, after which the applicable prize will remain unawarded. If a Potential Winner is an eligible minor in their jurisdiction of residence, the prize may be awarded in the name of their parent or legal guardian, who will be responsible for fulfilling all requirements.

 

6. PRIZES: One (1) Potential Winner will receive a selection of Biolage products. Approximate Retail Value (“ARV”) is $314.00. Product selection is determined by Sponsor. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. The winner may not substitute, assign, or transfer the prize or redeem the prize for cash. Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. The winner is responsible for all applicable federal, state, and local taxes. Sponsor reserves the right not to award a prize to a Potential Winner if the Potential Winner engages in activities that do not align with Sponsor’s values or acts in a disruptive manner, or with the effect to annoy, abuse, threaten, or harass any other person, all in the sole discretion of Sponsor. All prize details are at Sponsor’s sole discretion. Sponsor reserves the right not to award all prizes if it does not receive a sufficient number of eligible and qualified entries.

 

7. GENERAL CONDITIONS: Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, or garbled entries or mail. They are also not responsible for technical failures, human errors, or difficulties that may arise in connection with the Sweepstakes. Persons who tamper with or abuse any aspect of the Sweepstakes or website will be disqualified. Sponsor reserves the right to suspend, modify, or terminate the Sweepstakes if it is compromised. By participating, entrants agree that Sponsor and its respective affiliates and representatives will have no liability for any injuries, losses, or damages of any kind resulting from acceptance, possession, or use of any prize.

 

8. ARBITRATION: Except where prohibited by law, all disputes shall be resolved individually and exclusively by binding arbitration under the rules of the American Arbitration Association. The Federal Arbitration Act shall govern the interpretation and enforcement of these rules.

 

9. USE OF DATA: Sponsor will collect personal data from entrants in accordance with its privacy policy and Notice of Financial Incentives.
